UPDATE: 3:35 P.M. —

Capital Murder trial update: State and Defense in the Isidro Delacruz capital murder trial have rested and closed their cases.

Jury cannot deliberate until state and defense have made closing arguments.

Defense attorneys for Isidro Delacruz along with the state have rested and closed their cases in the capital murder trial for the defendant as of Wednesday afternoon.

Delacruz is facing a capital murder charge in the death of 5 year old Naiya Villegas–who was found at the 2700 block of Houston Street in September of 2014 with a cut to her throat.

Villegas would die as a result of her injuries.

The last of the three witnesses the defense called to the stand was Villegas’ mother, Tanya Bermea.

Bermea was asked about the relationship between Isidro Delacruz and Naiya Villegas prior to the incident.–she testified that Delacruz treated Villegas like she was his own daughter.

The state and defense will present their arguments pending the presentation of a charge by the judge in the case.

Jury deliberations can only begin after the state and defense have made their closing arguments.

Crime scene technicians continued testimony Wednesday morning in the Isidro Delacruz capital murder trial. Delacruz is the defendant in a case where 5 year old Naiya Villegas was found with two cuts to her throat in the early morning hours of September 2, 2014.

Day 8

When court began Wednesday morning crime scene technicians were speaking on behalf of photos taken of Tanya Bermea and Isidro Delacruz.

Bermea is the mother of the victim, Naiya Villegas.

Defense attorneys displayed defense exhibits to jurors which included a deep cut on the back of Delacruz’s upper left arm.

Prior exhibits showed Tanya’s fingertips were red–crime scene technicians testified that Tanya’s cuticles were inflamed and observed a “crusty red substance.”

The state would eventually rest its case against Delacruz as Garcia was excused from the stand with the defense asking for a “move to direct verdict on grounds the state did not have sufficient evidence.”

The judge would deny the defense’s motion.

The defense would then call Sgt. Gary Cole and Kelly Lajoie of the Tom Green County Sheriff’s Office and San Angelo Police Department (respectively).

Each defendant would testify regarding the process of obtaining incoming, outgoing and missed calls via a report which the defense would introduce as an exhibit to the court.

The report would show Tanya Bermea had made more than 30 outgoing calls in the span of 1:14 am until about 2:23 am on the night of September 2, 2014. The numbers of which belonged to an individual listed as “Liz,” an unknown caller and the mother of Tanya, Jesusita Bermea.

The defense is expected to re-call Tanya Bermea to the stand on this second week of testimony.
