Prosecutor: Murder charges to be filed against mother, boyfriend

LAS VEGAS - Cassie Smith and Joshua Oxford are facing additional charges including murder in the death of 3-year-old Daniel Theriot.

Both appeared in Las Vegas Justice Court Wednesday morning. The judge kept their bail at $100,000 pending additional charges. They are currently facing charges of child abuse, neglect and endangerment for Daniel's younger brother.

Prosecutor Pam Weckerly told the court the charges should be filed later today. She said the autopsy of Daniel revealed signs of "ongoing abuse at the hands of both individuals."

Theriot's body was found early Monday morning in a remote area near Lake Mead. Smith had reported him missing Sunday morning at Sunset Park, but police began to doubt her story due to inconsistencies.
